Dispute Resolution
We regularly provide services to clients to assist them in the resolution of contractual and commercial disputes on construction projects.
Typically, we will review the circumstances surrounding a particular problem to provide our client with an independent objective analysis of the circumstances behind the dispute, our views on responsibility, on how the dispute should be taken forward to resolution, and on the likely commercial outcome.
Commercial negotiation is usually the best way forward and we represent out clients in discussion with third parties to explain clearly where responsibility lies, and how the matter should best be resolved.
In the event of a formal dispute materialising, we work alongside solicitors on adjudication, arbitration and litigation proceedings, providing technical advice, co-ordination and a commercial perspective.
Shopping Centre, W. London
A major Department Store in London’s Bayswater was re-developed and extended to create a show piece shopping mall development.
The project suffered some very significant structural and building services problems during construction that led to very extensive delays in the opening of the centre.
Anser’s directors were engaged as part of a small team by the client to review the causes for the delay, to evaluate financially the disruption that had occurred and to work with their solicitors to put together and prosecute a claim against those liable.
The work entailed forensic research into what had gone on and the construction of critical path as-built programmes. Our client was successful in making a very substantial financial recovery through the courts.
