Dispute Resolution
We regularly provide services to clients to assist them in the resolution of contractual and commercial disputes on construction projects.
Typically, we will review the circumstances surrounding a particular problem to provide our client with an independent objective analysis of the circumstances behind the dispute, our views on responsibility, on how the dispute should be taken forward to resolution, and on the likely commercial outcome.
Commercial negotiation is usually the best way forward and we represent out clients in discussion with third parties to explain clearly where responsibility lies, and how the matter should best be resolved.
In the event of a formal dispute materialising, we work alongside solicitors on adjudication, arbitration and litigation proceedings, providing technical advice, co-ordination and a commercial perspective.
Primary Care Trust facility
We were appointed by a PCT in the Midlands to assist them to move forward a stalled project. Funding for the project came largely from a planning agreement relating to a large residential scheme locally.
After investigation, it became clear that the complicated legal and planning situation had allowed the housing development to proceed ahead of the PCT.
Having developed a clear understanding of the legal position, we were able to conclude the necessary agreements with the project partners to allow the PCT project works to commence on site.
