Dispute Resolution

We regularly provide services to clients to assist them in the resolution of contractual and commercial disputes on construction projects.

Typically, we will review the circumstances surrounding a particular problem to provide our client with an independent objective analysis of the circumstances behind the dispute, our views on responsibility, on how the dispute should be taken forward to resolution, and on the likely commercial outcome.

Commercial negotiation is usually the best way forward and we represent out clients in discussion with third parties to explain clearly where responsibility lies, and how the matter should best be resolved.

In the event of a formal dispute materialising, we work alongside solicitors on adjudication, arbitration and litigation proceedings, providing technical advice, co-ordination and a commercial perspective.

Anser were appointed as project manager by a private developer part way through construction on a difficult, mixed-use, new build development in Primrose Hill. The developer was experiencing problems with poor levels of quality, rising costs and the work falling significantly behind programme.

We provided a comprehensive consultancy service that included the management of the multi disciplinary team, difficult high level negotiation between construction and consultant teams, and dispute resolution.

The site was bordered by a road, railway and canal and supported several existing Victorian structures of local interest. Design and construction works required a high level of liaison with Local Community bodies, Local Authorities, English Heritage, Railtrack and British Waterways, which we also undertook.
